Filing 18 ORDER granting #2 Motion to Seal: Defendant Dole Packaged Foods, LLC (Dole) removed this case on July 2, 2022. The removal papers have redacted the dollar amount of sales of the Fruit Bowl products at issue in in this lawsuit. Dole has only redacted the dollar amount of sales, leaving the rest of the papers available for public viewing. Dole now moves to keep that information confidential and seeks leave to file unredacted versions of its Notice of Removal and the Declaration of Brian Thomas in support thereof under seal (Doc. #2 ). Dole contends that the redacted portions of the subject pleadings contain highly confidential sales figures which, if publicly disclosed, could cause harm to Dole. Plaintiff has not responded to the motion. Judicial proceedings leading to a final decision and materials on which a judicial decision rests are presumptively in the public domain. There are exceptions, however, to the general rule of access to court documents. For example, courts have sealed records or portions of them to prevent court files from serv[ing] as reservoirs of libelous statements for press consumption or to protect business information that might harm a litigant's competitive standing. Nixon v. Warner Communications, Inc., 435 U.S. 589, 598 (1978) (citations omitted). This includes records that reveal consumer and pricing data. See KM Enters., Inc. v. Glob. Traffic Techs., Inc., 725 F.3d 718, 734 (7th Cir. 2013). Having reviewed Doles motion, the Court finds that good cause exists to seal the proprietary information and that the request is narrow and specific. Accordingly, the motion is GRANTED.
