Filing 15 ORDER, granting in part #14 Motion for Extension of Time. By Motion dated December 28, 2022, Defendant Granite City Illinois Hospital Company, LLC d/b/a Gateway Regional Medical Center ("GRMC") seeks additional time to file its corporate disclosure statement. Defendant represents that it is in the process of being acquired by a new owner, and states that it will be unable to file its disclosure statement until after the acquisition is final. Defendant does not know when its transaction will become final, and thus requests until at least January 16, 2023 to file its disclosures. Fed. R. Civ. P. 7.1 requires nongovernmental corporate parties to file a corporate disclosure statement identifying any parent corporation or publicly held corporation owning 10% or more of its stock "with its first appearance, pleading, petition, motion, response, or other request addressed to the court." GRMC's acquisition understandably complicates its ability to complete its disclosure statement. However, the reasons necessitating prompt disclosures under Rule 7.1 outweigh those complications. Indeed, the disclosure requirements assist, in part, with assessing whether disqualification under Cannon 3C(1)(c) of the Code of Conduct for United States Judges may be required. See id. committee note on rules - 2002. Accordingly, the Court GRANTS Defendant's Motion (Doc. 14) IN PART. Defendant shall file its corporate disclosure statement by January 11, 2023. Defendant may then supplement its disclosure information after its acquisition is final, as contemplated by Rule 7.1(b)(2). See id. at (b)(2) ("A party must: promptly file a supplemental statement if any required information changes."). In the event Defendant believes additional circumstances surrounding its acquisition exempts it from filing Rule 7.1 disclosures, Defendant shall promptly bring those circumstances, and any legal authority supporting its position, to the Court's attention. (Action due by 1/11/2023). Signed by Judge David W. Dugan on 12/28/2022. (arm)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED. |
