December 29, 2022 Opinion or Order Filing 3 ORDER STAYING CASE. On December 2, 2022, Petitioner Bernard Mosley filed his Motion to Vacate, Set Aside or Correct Sentence pursuant to 28 U.S.C. 2255. However, because Petitioner is currently pursuing a direct appeal of his criminal sentence, the Court indicated that a stay of this proceeding would likely be appropriate (Doc. 2). Prior to imposing the stay, however, the Court provided Petitioner and the Government an opportunity to file objections to the proposed stay. The Court set an objection deadline of December 28, 2022. That deadline has now passed and no objections have been filed by the parties. Accordingly, the Court FINDS it is in the best interest of Petitioner and judicial economy to stay this matter. The case is therefore STAYED until such time as the United States Court of Appeals for the Seventh Circuit rules on Petitioner's pending criminal appeal in USCA Case No. 22-1843. The parties are DIRECTED to file a status report within 14-days of the Seventh Circuit's disposition of Petitioner's criminal appeal or by March 31, 2023, whichever is earlier.
