Filing 9 JURISDICTIONAL ORDER: This matter is before the Court sua sponte on the issue of federal subject matter jurisdiction. See Foster v. Hill, 497 F.3d 695, 696-97 (7th Cir. 2007) ("It is the responsibility of a court to make an independent evaluation of whether subject matter jurisdiction exists in every case."). Plaintiff Perry has filed a Complaint asserting that this Court has jurisdiction pursuant to 28 U.S.C. 1332, the diversity statute. (Doc. #1 ). The Complaint alleges that Plaintiff "is entitled to damages in an amount in excess of Seventy-Five Thousand Dollars ($75,000.00), including but not limited to damages for past and future medical care, loss of enjoyment of life, lost wages, and pain and suffering." (Doc. #1 , p. 3). Plaintiff also alleges that "the amount in controversy exceeds Seventy-Five Thousand Dollars ($75,000.00)." (Doc. #1 , p. 4). The problem is the Complaint fails to allege that the amount in controversy exceeds "$75,000, exclusive of interest and costs." 28 U.S.C. 1332 (emphasis added). Plaintiff must amend to properly allege diversity. The Amended Complaint shall be filed no later than December 29, 2022. If Plaintiff fails to file an Amended Complaint in a manner that addresses the item in this order and within the time prescribed or if, after reviewing it, the Court finds that Plaintiff does not properly establish subject matter jurisdiction, the Court may dismiss the action for lack of jurisdiction.
