March 21, 2023 Opinion or Order Filing 58 ORDER regarding Plaintiff's Motion for Leave to File a First Amended Complaint (Doc. 54). Plaintiff notes that Defendant, Daimler Truck North America, LLC, has a Motion to Dismiss Count IV of the Complaint (Doc. 44) pending under Federal Rule of Civil Procedure 12(b)(6). However, by requesting leave to file a First Amended Complaint, Plaintiff seeks to moot that Motion to Dismiss by deleting the liability theory challenged by Defendant Daimler. Other amendments to the Complaint seek to further explain Plaintiff's remaining liability theory against Defendant Daimler. Plaintiff also notes that the amendment is sought near the same time as the entry of a scheduling and discovery order. Consistent with Local Rule 15.1, Plaintiff submitted a proposed First Amended Complaint that tracks her revisions to the Complaint. Leave to amend shall be freely given when justice so requires; however, the Court has broad discretion to deny such a request in light of undue delay, bad faith, dilatory motive, repeated failure to cure deficiencies, undue prejudice to Defendants, or where the amendment would be futile. See Fed. R. Civ. P. 15(a)(2); Johnson v. Cypress Hill, 641 F.3d 867, 871-72 (7th Cir. 2011). Courts have concluded that an amendment is appropriate where the plaintiff seeks to simplify or clarify the cause of action. See Coons v. Yum! Brands, Inc., No. 21-45, 2021 WL 6286147, *2 (S.D. Ill. Nov. 30, 2021); Dennis v. Potter, No. 8-198, 2010 WL 987217, *2-3 (N.D. Ind. March 15, 2010); Leonelli v. City of Kendallville, No. 7-121, 2007 WL 7233495, *2-3 (N.D. Ind. Nov. 29, 2007); Wielgos v. Commonwealth Edison Co., No. 84-1222, 1987 WL 7499, *3 (N.D. Ill. Feb. 27, 1987). Under the aforementioned authorities, the Court FINDS it appropriate to grant Plaintiff leave to amend the Complaint in the present case. Accordingly, Plaintiff's Motion for Leave to File a First Amended Complaint is GRANTED. In light of this ruling, Defendant Daimler's Motion to Dismiss Count IV of the Complaint is DENIED without prejudice.
