Defendants' depositions were set to be completed by October 31, 2023, but several depositions remain outstanding. All parties agree to an extension of the time to complete those depositions. Accordingly, the Agreed Motion is GRANTED and the time for taking the depositions is EXTENDED to January 31, 2024. The parties are reminded that they may stipulate to modifications of the Scheduling and Discovery Order as long as the modifications do not impact the deadlines for completing all discovery, hearing a motion, or proceeding to trial. ORDER regarding Plaintiff's Motion for Leave to File a First Amended Complaint (Doc. 54). Plaintiff notes that Defendant, Daimler Truck North America, LLC, has a Motion to Dismiss Count IV of the Complaint (Doc. 44) pending under Federal Rule of Civil Procedure 12(b)(6). However, by requesting leave to file a First Amended Complaint, Plaintiff seeks to moot that Motion to Dismiss by deleting the liability theory challenged by Defendant Daimler. Other amendments to the Complaint seek to further explain Plaintiff's remaining liability theory against Defendant Daimler. Plaintiff also notes that the amendment is sought near the same time as the entry of a scheduling and discovery order. Consistent with Local Rule 15.1, Plaintiff submitted a proposed First Amended Complaint that tracks her revisions to the Complaint. Leave to amend shall be freely given when justice so requires; however, the Court has broad discretion to deny such a request in light of undue delay, bad faith, dilatory motive, repeated failure to cure deficiencies, undue prejudice to Defendants, or where the amendment would be futile. See Fed. R. Civ. P. 15(a)(2); Johnson v. Cypress Hill, 641 F.3d 867, 871-72 (7th Cir. 2011). Courts have concluded that an amendment is appropriate where the plaintiff seeks to simplify or clarify the cause of action. See Coons v. Yum! Brands, Inc., No. 21-45, 2021 WL 6286147, *2 (S.D. Ill. Nov. 30, 2021); Dennis v. Potter, No. 8-198, 2010 WL 987217, *2-3 (N.D. Ind. March 15, 2010); Leonelli v. City of Kendallville, No. 7-121, 2007 WL 7233495, *2-3 (N.D. Ind. Nov. 29, 2007); Wielgos v. Commonwealth Edison Co., No. 84-1222, 1987 WL 7499, *3 (N.D. Ill. Feb. 27, 1987). Under the aforementioned authorities, the Court FINDS it appropriate to grant Plaintiff leave to amend the Complaint in the present case. Accordingly, Plaintiff's Motion for Leave to File a First Amended Complaint is GRANTED. In light of this ruling, Defendant Daimler's Motion to Dismiss Count IV of the Complaint is DENIED without prejudice. In accepting the Joint Report, the Court notes that the parties failed to reach an agreement on the disclosure and deposition deadlines for expert witnesses. Accordingly, the Court SETS the following disclosure deadlines: 6(a) Plaintiffs' expert witnesses shall be disclosed by: February 1, 2024; 6(b) Defendants' expert witnesses shall be disclosed by: April 1, 2024; 7(a) Plaintiffs' expert(s) shall be deposed by March 1, 2024; and 7(b) Defendants' expert(s) shall be deposed by May 1, 2024. The parties are advised that their consent is required if the assigned Magistrate Judge is to conduct all further proceedings in the case, including trial and final entry of judgment pursuant to 28 U.S.C. 636(c) and Federal Rule of Civil Procedure 73. As set forth in Administrative Order No. 257, each party will be required to file a Notice and Consent to Proceed Before a Magistrate Judge Jurisdiction form indicating consent or nonconsent to the jurisdiction of the assigned Magistrate Judge. If all parties do not consent to the Magistrate Judge's jurisdiction, the case will be randomly assigned to a district judge for all further proceedings and the parties cannot later consent to reassignment of the case to a magistrate judge. The parties are further advised that they are free to withhold consent without adverse substantive consequences. Within 21 days of this Notice, the following party or parties must file the attached form indicating consent to proceed before the assigned Magistrate Judge or an affirmative declination to consent: All Parties.
