Filing 10 ORDER GRANTING #4 Motion for Leave to Proceed in forma pauperis. A federal court is authorized under 28 U.S.C. sec. 1915(a)(1) to permit an indigent party to proceed in a civil action without prepaying the filing fee if the party "submits an affidavit that includes a statement of all assets [he] possesses [showing] that the person is unable to pay such fees or give security therefor." The Court is satisfied from Plaintiff's affidavit that he is indigent. Therefore, the Court GRANTS the motion to proceed in forma pauperis without prepayment of fees and costs. The Court notes, however, that should it become apparent that the action is frivolous or malicious at any time in the future, it may dismiss the case pursuant to 28 U.S.C. sec. 1915(e)(2)(B)(i).Signed by Magistrate Judge Mark A.
