ORDER Regarding 2255 Petition: Petitioner Charles Curren filed a letter in his criminal case (20-cr-30165-DWD) seeking an extension of time to file an appeal. Because the Court lacked authority to grant the requested relief, the motion was denied. The Court, however, noted that the issue raised in Curren's motion might be the proper subject of a motion brought under 28 U.S.C. 2255. The Court advised Curren that, unless he filed a motion to withdraw or amend his filing, the Court would construe it as a 2255 motion and direct the Clerk of Court to open a new civil case on his behalf. Curren did not file a motion to withdraw or amend the filing. Accordingly, the Court opened the instant case. The Court DIRECTS the Clerk of Court to send Curren a form for filing a 2255 motion.
