Filing 5 ORDER: The Complaint (Doc. #1 ) in this newly-filed action appears to largely duplicate Plaintiff's claims in Walker v. Thompson, Case No. 23-1466-SMY (filed May 1, 2023). Plaintiff names the same Defendants in both cases (but adds Centralia Correctional Center as a party in this new case). Plaintiff's claims in both cases arise from the same incident of electrocution at Centralia in 2021. Plaintiff is therefore ORDERED to notify the Court in writing, on or before August 1, 2023, whether he intended to file a new, separate case when he submitted the Complaint on July 13, 2023, filed under Case No. 23-2430-SMY, or whether the new Complaint should be filed as an amended pleading in the original case (No. 23-1466-SMY). If Plaintiff wishes to proceed only in the original case, the new action (No. 23-2430-SMY) will be closed and no new filing fee will be assessed. ( Action due by 8/1/2023.). Signed by Judge Staci M. Filing 3 NOTICE AND ORDER: The Court has received your complaint and your motion to proceed without prepayment of the filing fee. Your case number is 23-2430-SMY. The following is some information you should know regarding the initial stages of your lawsuit.
