ORDER: Plaintiff Micheal Attaway has filed a #10 Motion to Withdraw Lawsuit, which the Court construes as a Notice of Dismissal. Under Federal Rule of Civil Procedure 41(a)(1)(A)(i), a plaintiff may dismiss an action without a court order by filing a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment. Since the opposing party in this case has not filed an answer or a motion for summary judgment, the Notice of Dismissal is effective immediately upon filing and does not require judicial approval.
