November 17, 2023 Opinion or Order Filing 16 ORDER: This case is before the Court sua sponte for case management purposes. This case was removed here pursuant to 42 U.S.C. sec. 233 (Doc. 1), and Plaintiff did not file a motion to remand. The Notice of Removal indicates that Defendant Southern Illinois Hospital Services ("SIHS") filed a motion to dismiss in state court on September 12, 2023 before the case was removed (Doc. 1, p. 2; Doc. 1-3). There is no indication that Plaintiff filed a response to SIHS's motion to dismiss in state court prior to removal, nor did Plaintiff file a response in this Court following removal. Plaintiff also did not file a response to the motion to dismiss or the motion for summary judgment filed by Defendants Shawnee Health Service & Development Corporation and Megan Walker (Docs. 3, 4). See SDIL-LR 7.1(b)(1) (setting a 30-day response deadline for motions to dismiss and motions for summary judgment). In order to make the record clear, Defendant SIHS shall REFILE its motion to dismiss, which will be deemed filed as of September 13, 2023. Plaintiff is sua sponte granted through December 1, 2023, to file responses to Defendant SIHS's motion to dismiss and Defendants Shawnee and Walker's motion to dismiss and motion for summary judgment.
