November 3, 2023 Opinion or Order Filing 4 ORDER: Plaintiff filed a #1 Complaint to challenge an extradition order recently entered against him, and to request freedom from extradition. (Doc. 1). Plaintiff commenced this action under 28 U.S.C. 1331 and 42 U.S.C. 1985 without prepaying the $402 filing fee or submitting a Motion for Leave to Proceed In Forma Pauperis (IFP Motion). A person resisting an extradition must seek a writ of habeas corpus and may also request a stay of extradition while his petition for a writ is considered. See, e.g., DeSilva v. DiLeonardi, 181 F.3d 865 (7th Cir. 1999); In re Assarsson, 635 F.2d 1237 (7th Cir. 1980). The Court lacks authority to stay or overturn the extradition order herein or convert this action to a habeas proceeding. See Copus v. City of Edgerton, 96 F.3d 1038 (7th Cir. 1996). Therefore, on or before DECEMBER 2, 2023, Plaintiff must: (a) notify the Court, in writing, if he would like to proceed with this action under 28 U.S.C. 1331 and 42 U.S.C. 1985; AND (b) prepay the $402 filing fee or submit an IFP Motion by the same deadline. If he does not wish to proceed, Plaintiff should simply file a motion to voluntarily dismiss this case by the same deadline. Failure to comply with this Order shall result in dismissal of this action after this deadline expires. See Fed. R. Civ. P. 41. The Clerk's Office is DIRECTED to SEND Plaintiff blank Petitions for Writ or Habeas Corpus Under 28 U.S.C. 2241 and 2254, along with a copy of this Order. Signed by Judge J.
