December 21, 2023 Opinion or Order Filing 9 ORDER: On December 18, 2023, Defendant removed this attorney-filed case from state court. (Doc. 1). The case concerns a female inmate who sustained an injury to her pinky finger at the Madison County Jail. The Court notes that the factual allegations in this removed action appear to be largely duplicative of the allegations made in a pro se complaint filed by the same PlaintiffMartin v. Butler, et al., 23-cv-1881-NJR (filed May 31, 2023). Given the apparent overlap in these matters, the parties are DIRECTED to review both matters, and to inform the Court as to whether they believe both matters should proceed, or whether one should be dismissed or consolidated into the other. The parties shall have 21 days, until January 11, 2024, to inform the Court of their intentions for this case. Additionally, defense counsel has moved for a 30 day extension to file a responsive brief in this case. The Motion (Doc. 7) is GRANTED. Any responsive pleading shall be filed by January 24, 2024. December 19, 2023 Opinion or Order Filing 5 NOTICE AND ORDER: Defendants, paying the full filing fee, removed this action from state court on 12/18/2023. The case has been assigned to Judge David W. Dugan and all pleadings shall bear the case number 23-3964-DWD.The Complaint appears to be a civil action, filed by a prisoner (as defined by the Prison Litigation Reform Act), seeking redress from a governmental entity and/or officer or employee of a governmental entity. Such actions are subject to a preliminary merits review pursuant to 28 U.S.C. Sec. 1915A. Martin v. United States, 96 F.3d 853, 854 (7th Cir. 1996). Accordingly, if the Court finds that removal is proper, the Court will proceed with reviewing the Complaint pursuant to Section 1915A. The Court will conduct this review within the next 60 days and inform the parties of the findings in a Merit Review Order. If the parties do not receive a Merit Review Order within the next 60 days, a motion for status may be filed. If the Complaint survives the merit review, further information and instruction will be provided at that time. Any communication directed to the Court should be in the form of a motion or other pleading and not a letter. All mail should be sent to: Clerk's Office, U.S. District Court, 750 Missouri Avenue, East St. Louis, IL 62201.
