ORDER GRANTING #3 Verified Motion to Appoint Special Representative. Plaintiff Mary Cummings asks the Court to appoint her Special Representative of the Estate of Harland L. Cummings pursuant to 735 ILCS 5/2-1008(b)(1). That statute, however, only applies if a party to an action dies. Here, Harland L. Cummings was not a party to this action at the time of his death because this action had not been filed yet. Therefore, the Court instead appoints Mary Cummings as Special Representative of the Estate of Harland L.
