March 29, 2024 Opinion or Order Filing 15 ORDER GRANTING #14 Motion to Clarify Filing Fee by Charles E. Thornton. Plaintiff was ordered to show cause on or before March 19, 2024 why this case should not be dismissed based on his failure to either prepay the $405 filing fee or file a motion for leave to proceed in forma pauperis (IFP motion) (due 3/4/2024). Plaintiff now asks why he owes $405.00 for his filing fee when various statutes, including 28 U.S.C. 1914 and 28 U.S.C. 1915(b)(1)(3), indicate that he is only required to pay $350.00. The reduced fee of $350.00 applies to plaintiffs who are granted IFP based on their indigence. Plaintiff has still not filed an IFP motion, so he owes $405.00. March 19, 2024 Opinion or Order Filing 13 NOTICE OF IMPENDING DISMISSAL: Plaintiff was ordered to show cause on or before March 19, 2024 why this case should not be dismissed based on his failure to file his Notice and Consent to Proceed Before A Magistrate Judge (due 2/22/2024) and either prepay the $405 filing fee or file a motion for leave to proceed in forma pauperis (IFP motion) (due 3/4/2024). Plaintiff filed two separate responses (Docs. 11 and 12), confirming that he filed his Notice and Consent to Proceed Before a Magistrate Judge at Doc. 5 and confirming that he missed the deadline for paying his filing fee or filing an IPF motion due to a medical emergency from February 26 - March 8, 2024. However, Plaintiff still has not submitted his IFP motion, prepaid his $405 filing fee, or requested an extension of time to do so. Accordingly, the Court finds that Plaintiff has NOT satisfied the 10 Order to Show Cause.
