April 19, 2024 Opinion or Order Filing 18 ORDER GRANTING Plaintiff's motion to proceed in forma pauperis ("IFP") (Doc. #3 ). Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $23.91. Plaintiff is ORDERED to pay the initial partial filing fee of $23.91 within FOURTEEN DAYS of the entry of this Order (on or before May 3, 2024). This payment shall be mailed to: Clerk of the Court, United States District Court for the Southern District of Illinois, 750 Missouri Avenue, East St. Louis, Illinois 62201. Additionally, because Plaintiff is no longer detained or incarcerated, he must pay the remaining balance of the $350 filing fee ($326.09) or file an updated motion to proceed IFP with regard to the balance within FOURTEEN DAYS of the entry of this Order (on or before May 3, 2024). Robbins v. Switzer, 104 F.3d 895, 899 (7th Cir. 1997). The Clerk is DIRECTED to send Plaintiff a blank Motion for Leave to Proceed IFP form along with a copy of this Order. Plaintiff is WARNED that failure to comply with this Order will result in the dismissal of this case under Federal Rule of Civil Procedure 41(b). Signed by Chief Judge Nancy J. April 19, 2024 Opinion or Order Filing 17 ORDER granting #16 Motion for Extension of Time. Plaintiff asks for additional time to obtain the consents of the defendants to proceed before the magistrate judge. Plaintiff only needs to note on the form whether he consents to magistrate judge jurisdiction. He does not need to obtain any other party's consent. To the extent that Plaintiff requests additional time to provide financial documents, his request is denied as moot. Plaintiff already has a motion to proceed in forma pauperis pending and the Court does not require any additional financial documentation at this time. Consent now due 5/10/2024. April 2, 2024 Opinion or Order Filing 15 ORDER TO SHOW CAUSE: Consistent with Administrative Order No. 257, Burns was previously directed to file the attached form indicating consent to proceed before the Magistrate Judge or an affirmative declination to consent. The time for doing so has long passed, and in spite of a warning and additional time to do so, said party continues to ignore the Court's directive by not returning the form. Thus, Burns is ordered to SHOW CAUSE why sanctions should not be imposed for failure to file the attached form as is required under Administrative Order No. 257.
