March 8, 2024 Opinion or Order Filing 4 ORDER DISMISSING #1 Complaint. This case was opened upon receipt of a Complaint filed by Plaintiff on March 7, 2024. The Complaint includes no statement of claim and no request for relief, in violation Rule 8 requiring a complaint to contain a short statement of the claim(s) and a demand for the relief sought. Fed. R. Civ. P. (8)(a)(3). In addition, Plaintiff paid no filing fee ($405) and filed no Motion for Leave to Proceed in forma pauperis (IFP motion). Under the circumstances, the Complaint is DISMISSED without prejudice. If Plaintiff intends to pursue his claims in this case, he must file a First Amended Complaint on or before APRIL 8, 2024, along with the $405 filing fee or an IFP motion. If he chooses to proceed, he will be obligated to pay the fee for this action, whether or not it survives review under 28 U.S.C. 1915(e)(2). If he does not wish to proceed any further, Plaintiff may instead file a Motion to Voluntarily Dismiss Case by APRIL 8, 2024, and the Court will close this case without the assessment of a filing fee.
