ORDER ON THRESHOLD JURISDICTIONAL REVIEW: In this action for declaratory judgment, Plaintiffs have sued Defendant, Elizabeth Robson, as Administrator of the Estate of Reno Keith Jr., Deceased, invoking this Court's 28 U.S.C. 1332(a)(1) diversity jurisdiction. The Complaint, however, does not contain all the information necessary for this Court to know whether it has subject matter jurisdiction. See Wernsing v. Thompson, 423 F.3d 732, 743 (7th Cir. 2005) ("[N]ot only may the federal courts police subject matter jurisdiction sua sponte, they must.") (internal citation omitted). According to the Complaint, Plaintiffs are insurance companies incorporated and existing under the laws of the State of New Hampshire, with their principal places of business in the Commonwealth of Massachusetts. While Plaintiffs plead that Elizabeth Robson is a citizen of Illinois, as the legal representative of a decedent's estate she is, for federal diversity purposes, a citizen as the same state as the decedent. 28 U.S.C. 1332(c)(2); Gustafson v. zumBrunnen, 546 F.3d 398, 400 (7th Cir. 2008). Accordingly, the Court DIRECTS Plaintiffs to file a supplemental pleading identifying the citizenship of the decedent, on or before May 6, 2024. Signed by Judge David W. Dugan on 4/30/2024.
