Filing 13 ORDER DISMISSING CASE, GRANTING #12 MOTION to Withdraw filed by Billy Miles. On June 3, 2024, the Court denied Miles's request to proceed in forma pauperis because he has three "strikes" pursuant to 28 U.S.C. 1915(g). He was directed to pay the full filing fee or move to voluntarily dismiss this action and avoid a filing fee. On June 6, 2024, Miles filed a motion requesting to withdraw his case. The motion is GRANTED. Miles's Complaint is voluntarily DISMISSED without prejudice. The Clerk of Court need not make further attempts to collect a filing fee. Plaintiff is a pro se litigant who was unaware of the implications of his strikes. He is now on notice that if he files future new matters, filing fees may be collected.
