May 2, 2024 Opinion or Order ORDER DISMISSING CASE: On May 1, 2024, Plaintiff filed a #5 Motion to Voluntarily Dismiss Case, in which he informed the Court that he does not wish to proceed with this action. The Court has not yet screened the Complaint under 28 U.S.C. 1915A, and Defendants have not yet answered. Pursuant to Rule 41(a)(1)(A)(i), Fed. R. Civ. P., Plaintiff's request for voluntary dismissal of this suit at this stage "effected the immediate dismissal of the suit." Nelson v. Napolitano, 657 F.3d 586, 587 (7th Cir. 2011); see also Smith v. Potter, 513 F.3d 781, 782 (7th Cir. 2008). No additional action remains for the undersigned Judge to take. The #5 Motion to Voluntarily Dismiss Case is GRANTED, the pending #2 Motion to Stay Proceedings is TERMINATED, and this case is considered DISMISSED without prejudice. April 23, 2024 Opinion or Order Filing 3 NOTICE AND ORDER: Defendants, paying the full filing fee, removed this action from state court on 4/22/2024. The case has been assigned to Judge J. Phil Gilbert and all pleadings shall bear the case number 24-1154-JPG.The Complaint appears to be a civil action, filed by a prisoner (as defined by the Prison Litigation Reform Act), seeking redress from a governmental entity and/or officer or employee of a governmental entity. Such actions are subject to a preliminary merits review pursuant to 28 U.S.C. Sec. 1915A. Martin v. United States, 96 F.3d 853, 854 (7th Cir. 1996). Accordingly, if the Court finds that removal is proper, the Court will proceed with reviewing the Complaint pursuant to Section 1915A. The Court will conduct this review within the next 60 days and inform the parties of the findings in a Merit Review Order. If the parties do not receive a Merit Review Order within the next 60 days, a motion for status may be filed. If the Complaint survives the merit review, further information and instruction will be provided at that time. Any communication directed to the Court should be in the form of a motion or other pleading and not a letter. All mail should be sent to: Clerk's Office, U.S. District Court, 750 Missouri Avenue, East St. Louis, IL 62201. Finally, Petitioner is advised that if his address changes, he must notify the Court within fourteen days of the change by filing a Notice of Change of Address.
