August 20, 2024 Opinion or Order Filing 10 ORDER denying #9 Motion for Reconsideration re 6 Order on Motion for TRO. Plaintiff's motion for injunctive relief was denied because he sought an order stopping harassment and retaliation by officials at Menard Correctional Center, but he was no longer housed at Menard or in contact with any of the defendants. His request for relief was denied as moot. Plaintiff now argues that his request was not moot because he included Rob Jeffreys as a defendant and he is over all of the prisons, including the prison where Plaintiff is currently housed. But there are no allegations to suggest that Jeffreys has harassed Plaintiff or retaliated against him in any way. Plaintiff vaguely mentions that he continues to suffer constitutional violations at subsequent prisons but fails to indicate what those violations are or whether Jeffreys was personally involved in those violations. July 23, 2024 Opinion or Order Filing 6 ORDER DENYING as moot #2 Motion for TRO. Plaintiff's pleading is not a motion but a proposed order for defendants to show cause as to why a preliminary injunction should not be entered. Plaintiff's Complaint seeks a preliminary injunction ordering the defendants to adopt a new prison policy regarding prison rape (Doc. 1, p. 59) but his "motion" requests an order to enjoin defendants at Menard Correctional Center from violating Plaintiff's constitutional rights. Specifically, Plaintiff seeks an order enjoining defendants from retaliating against and harassing him. Plaintiff, however, is no longer housed at Menard Correctional Center. He is currently at Lawrence Correctional Center and Plaintiff has not demonstrated that he is likely to transfer back to Menard. Thus, his request for injunctive relief at Menard is MOOT. See Pearson v. Welborn, 471 F.3d 732, 743 (7th Cir. 2006); Higgason v. Farley, 83 F.3d 807, 811 (7th Cir. 1996). Signed by Chief Judge Nancy J. Rosenstengel on 7/23/2024.
