ORDER: On February 14, 2025, Defendant RTX Corporation removed this case from Madison County Circuit Court pursuant to the federal officer removal statute. RTX and Plaintiffs later filed a Stipulation to Remand Removed Action (Doc. #4 ) stating, "after some discussion, the parties have agreed that this action should be remanded" back to state court. The parties do not point to any defect or otherwise claim that removal was improper. The law is clear that if a case is properly removed, such as this case, a court may not remand it based on a discretionary reason not set forth by the controlling statute. Thermtron Products, Inc. v. Hermansdorfer, 423 U.S. 336, 344, 345 n. 9. (1976); Lawrence v. Fairfield Processing Corporation, 2022 WL 10423622 (E.D. Mo. 2022) (collecting cases). This includes a mutually requested "do over".
