ORDER denying #37 Motion to call witnesses, #39 Notice and Motion for Relief. Plaintiff seeks to have several inmates testify at the scheduled motion hearing, alleging that they can testify to also being subjected to the strip-out policy or witnessed Plaintiff lose his property. The Court finds that this testimony appears to be duplicative of Plaintiff's own testimony regarding his experiences at Menard. If, after hearing Plaintiff's testimony and any testimony from Defendants, the Court finds that additional testimony/evidence would be valuable, the Court will take further steps to secure the presentation of that additional evidence. To the extent Plaintiff believes a specific witness would be able to provide testimony or evidence that he would not be able to present, he should be prepared to further explain what he expects those witnesses would offer in the way of testimony. To the extent that Plaintiff seeks immediate injunctive relief prior to the hearing, he has not shown that he will suffer irreparable harm before the hearing which is scheduled for February 25, 2026. Although he alleges that as of February 13, 2026 he was still without his property, current warden Matthew Plummer indicated that Jones had all of the property that is allowed in restrictive housing including hygiene items (Doc. 38-1). ORDER re #30 MOTION for Preliminary Injunction and #29 MOTION to Supplement filed by Gerald Jones. Plaintiff filed two recent motions about his current status. Although both are labeled motions, the filings are supplements to his original motion for injunctive relief. He alleges that he has again been subject to the "strip-out" policy and had all of his property taken away from him. In response to Plaintiff's original motion for emergency preliminary injunctive relief, Warden Anthony Wills stated in an affidavit that Plaintiff was subject to a loss of property due to his attempts at self-harm as opposed to any policy for refusing housing (Doc. 15-4). Plaintiff notes that Wills is no longer the warden at Menard and was incorrect about his loss of property. Plaintiff claims that he is currently subject to the strip-out policy and has recently suffered numerous self-harm events as a result of the policy. He notes that he lacks clean underwear, deodorant, toothpaste, and a clean shirt. He smells due to the inability to shower. In light of the concerning nature of the updated allegations, the Court DIRECTS Defendants to submit an affidavit from the current warden of Menard responding to the new allegations (Docs. 29, 30), specifically indicating Plaintiff's current status (whether he is on crisis watch, in segregation, or in general population), and explaining the January 16, 2026 incident which Plaintiff alleges led to his loss of property. ORDER GRANTING Plaintiff's motion to proceed in forma pauperis ("IFP") (Doc. #2 ). Plaintiff has been without funds for six months, he is currently without funds, and he appears to have no means currently with which to pay an initial partial filing fee. Accordingly, the Court will not assess an initial partial filing fee. See 28 U.S.C. 1915(b)(4). Plaintiff shall make monthly payments of 20% of the preceding month's income credited to Plaintiff's prison trust fund account (including all deposits to the inmate account from any source) until the $350.00 filing fee is paid in full. The agency having custody of Plaintiff shall forward payments from Plaintiff's account to the Clerk of this Court each time the amount in the account exceeds $10 until the $350.00 filing fee is paid. In addition, Plaintiff shall note that the filing fees for multiple cases cumulate. See Newlin v. Helman, 123 F.3d 429, 436 (7th Cir. 1997), overruled in part on other grounds by Lee v. Clinton, 209 F.3d 1025 (7th Cir. 2000); Walker v. O'Brien, 216 F.3d 626 (7th Cir. 2000). A prisoner who files one suit must remit 20% of his monthly income to the Clerk of the Court until his fees have been paid; a prisoner who files a second suit or an appeal must remit 40%; and so on. Newlin, 123 F.3d at 436. "Five suits or appeals mean that the prisoner's entire monthly income must be turned over to the court until the fees have been paid." Id. Payments shall be mailed to: Clerk of the Court, United States District Court for the Southern District of Illinois, 750 Missouri Avenue, East St. Louis, Illinois 62201.
