ORDER: The Court GRANTS the #18 Motion to Dismiss filed by Plaintiff Taylor. Plaintiff Taylor and his claims are DISMISSED from this lawsuit without prejudice. As for Plaintiff Corey, he has expressed the desire to continue litigating this case, and he asserts that the omissions in his original motion to proceed IFP were not intentional. (Doc. #19 ). Plaintiff Corey states that at time of initiating this lawsuit, he had recently been taken into police custody, he did not have access to funds, and he did not know that his previous employer would be putting money into this account after filing this suit. Based on these statements, the Court deems the Show Cause Order SATISFIED. Plaintiff Corey is DIRECTED to refile his motion to proceed IFP or pay the $405.00 filing fee on or before July 6, 2026. Plaintiff Corey is advised to read the IFP form thoroughly and include information regarding all of his income for the last 12 months, including his work compensation benefits or other sources (question #3), the amount of money in his checking and/or savings accounts (question #4), and property ownership (question #5). See Thomas v. Gen. Motors Acceptance Corp., 288 F.3d 305, 306 (7th Cir. 2002) (affirming the dismissal of a case where the plaintiff did not update his IFP petition when he received a disbursement of retirement funds). Now that Plaintiff Taylor has been dismissed from this case, Plaintiff Corey is further DIRECTED to file an amended complaint that pertains only to his allegations and claims by July 6, 2026. The Clerk of Court is DIRECTED to send Plaintiff Corey a blank motion to proceed in forma pauperis form and a blank civil rights complaint form. Plaintiff Corey is advised that the filing fee is mandated by federal statute, and the "act of filing this case triggered the plaintiff's obligation to pay the filing fee," regardless of the outcome of the case. Christophel v. Husz, No. 08-cv-935, 2009 WL 4544737, at *2 (E.D. Wis. Nov. 25, 2009) (citing 28 U.S.C. 1915(b)). If Plaintiff Corey fails to renew his IFP motion or pay the full filing and file an amended complaint by July 6, 2026, then this case will be dismissed for failure to comply with orders of this Court and for failure to prosecute.
