Order for Service of Process: Plaintiff's Motion to Substitute (Doc. 35) is GRANTED in part. The Clerk of Court shall replace John Doe with Terri Wingerter, and shall serve Wingerter consistent with the Order for Service of Process (Doc. 17). By contrast, Plaintiff's Motion to Substitute (Doc. 35) is DENIED in part and he may not add two additional partiesgallery officers Ryan Ramsey and Ethan Tellor. The problem with trying to add Ramsey and Tellor by the Motion to Substitute is that Plaintiff makes new factual allegations about these two that are not in the amended complaint, and piecemeal amendments are not acceptable. If Plaintiff would like to add Ramsey and Tellor, he should file an amended complaint that repeats his allegations against Wingerter and adds the details he wishes to assert against Ramsey and Tellor. ORDER: Plaintiff's Fourth Motion for a Preliminary Injunction (Doc. 31) is DENIED. This case concerns conditions of confinement that Plaintiff attributes to a sole John Doe defendant in June and July of 2025. Other claims in the case against officers Kulich and Young were previously dismissed as insufficient to state a claim (Doc. 17). In the present motion for injunctive relief, Plaintiff complains that Defendant Kulich has recently harassed him and has exhibited retaliatory conduct. As the Court has previously explained in relation to the Third Motion for a Preliminary Injunction, injunctive relief will not be granted if it is not related to the claims or parties in the lawsuit. Here, the only claim concerns conditions of confinement in June and July of 2025, and does not involve Kulich. Thus, Plaintiff's request for a prison transfer on the premise of retaliation by Kulich is not an appropriate basis for relief in this case. Plaintiff's Motion (Doc. 31) is DENIED. ORDER: Plaintiff's Motion for Status (Doc. 29) is GRANTED by issuance of this Order. Plaintiff indicates that John Doe identification is ongoing, and he asks about next steps. As the Court previously explained, the Warden of Menard was directed to provide information to Plaintiff about John Doe, and the Warden has now confirmed as of June 3, 2026, that he provided this information. Therefore, Plaintiff is now responsible for filing a motion to substitute to give the Court the name of the John Doe "placement officer" who he claims violated his rights on June 23, 2025 and July 10, 2025. ORDER GRANTING Plaintiff's motion for leave to proceed in forma pauperis ("IFP") (Doc. 2). Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $36.03. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court upon receipt of this Order. Plaintiff shall make monthly payments of 20% of the preceding month's income credited to Plaintiff's prison trust fund account (including all deposits to the inmate account from any source) until the $350.00 filing fee is paid in full. The agency having custody of Plaintiff shall forward payments from Plaintiff's account to the Clerk of this Court each time the amount in the account exceeds $10.00 until the $350.00 filing fee is paid. In addition, Plaintiff shall note that the filing fees for multiple cases cumulate. See Newlin v. Helman, 123 F.3d 429, 436 (7th Cir. 1997), overruled in part on other grounds by Lee v. Clinton, 209 F.3d 1025 (7th Cir. 2000); Walker v. O'Brien, 216 F.3d 626 (7th Cir. 2000). A prisoner who files one suit must remit 20% of his monthly income to the Clerk of the Court until his fees have been paid; a prisoner who files a second suit or an appeal must remit 40%; and so on. Newlin, 123 F.3d at 436. "Five suits or appeals mean that the prisoner's entire monthly income must be turned over to the court until the fees have been paid." Id. Payments shall be mailed to: Clerk of the Court, United States District Court for the Southern District of Illinois, 750 Missouri Avenue, East St. Louis, Illinois 62201. The Clerk is DIRECTED to send a copy of this Order to the Trust Fund Officer at Menard Correctional Center upon entry of this Order. Signed by Judge David W. Dugan on 1/21/2026.
