He therefore requests that this Court withdraw his #3 Original Complaint. However, when an amended complaint is filed, the prior complaint is automatically withdrawn as superseded by the amended complaint. Johnson v. Dossey, 515 F.3d 778, 780 (7th Cir. 2008). Because no defendants have yet been served, Strode was permitted to file this first amended complaint as a matter of course under Federal Rule of Civil Procedure 15(a)(1). Strode's motion, therefore, is unnecessary; his original complaint was automatically withdrawn when he filed the amended complaint. Accordingly, the #6 Motion to Withdraw is DENIED as moot.
