July 7, 2026 Opinion or Order Filing 16 ORDER GRANTING #15 Plaintiff Ronnell Hunter's Motion to Appoint the U.S. Marshals Service for Service of Process. Under Rule 4(c)(3) of the Federal Rules of Civil Procedure, at the plaintiffs request, a court may order that service be made by the United States Marshals Service ("USMS"). Accordingly, the Court DIRECTS the Clerk of Court to provide Hunter with USM-285 forms. Hunter is ORDERED to return the completed forms to the Clerk of Court along with the completed summons. Upon receipt of the completed USM-285 forms, the Clerk is DIRECTED to prepare and issue a service packet consisting of the summons, USM-285 form, and a copy of the Amended Complaint (Doc. #14 ) to the USMS. The Court DIRECTS the USMS, upon receipt of these documents, to serve a copy of the summons and Amended Complaint upon the Defendants in any manner consistent with Rule 4, as directed by Hunter. Because Hunter is not indigent, however, service will not be effected at the Government's expense. Hunter is advised that the USMS is authorized by law to charge fees for service of process. May 27, 2026 Opinion or Order Filing 7 ORDER: Plaintiff Ronnell M. Hunter has filed a Complaint alleging violations of his civil rights under 42 U.S.C. 1983 and related state law claims, and he has paid the filing fee. Plaintiff must now serve Defendants with a copy of the Complaint and a summons. This must be completed within 90 days of the complaint being filed. Fed. R. Civ. P. 4(c) & (m). Plaintiff must present a summons to the clerk for signature and seal and request that summons be issued. Fed. R. Civ. P. 4(a) & (b). Plaintiff's #4 Motion for Leave to File Electronically and Request for Remote Appearance is GRANTED in part and DENIED in part. Plaintiff's request to attend all non-evidentiary hearings remotely is DENIED. While status conferences may be held by videoconference, the Court may order Plaintiff to attend motion hearings and other court proceedings in person. Plaintiff is hereby GRANTED access to the District Court's electronic case filing system. See SDIL-LR 5.1. To access the system, Plaintiff must complete the application for "Non-Attorney E-File Registration" located on the Maintenance tab within his personal PACER account. Plaintiff has 14 days to complete this process and e-file a notice with the Court certifying that this process has been completed. If Plaintiff does not complete this process within 14 days and so notify the Court, the permission to e-file will be revoked without further notice or warning. Plaintiff is ADVISED that once he is registered for e-filing, the Clerk's Office will no longer mail paper copies of documents that are filed, and Plaintiff may no longer submit paper filings by U.S. mail or through intake at the Clerk's Office. Plaintiff is further ADVISED that there are fees associated with using PACER. If Plaintiff wishes to have these fees waived, he must file a Motion for Exemption of PACER Fees that explains why an exemption is warranted.
