The pending motion for sanctions filed by Bendix (Doc. 389 in 20-cv-1355) does not justify a cessation of discovery, nor does it support a modification of the final scheduling order entered on December 10, 2025 (Doc. 369 in 20-cv-1355). The parties SHALL continue to engage in discovery cooperatively and schedule outstanding depositions as soon as possible. The Court CLARIFIES that its recent order consolidating cases (Doc. 394 in 20-cv-1355) only consolidates for administrative purposes. The Court will address the question of whether the consolidated counterclaim will be tried with the claims in this action at a later date and in consultation with the parties. A status conference will be scheduled for the week of August 24, 2026. ORDER CONSOLIDATING CASES: Respondent, Navistar, Inc. (n.k.a. International Motors, LLC) filed an unopposed motion to consolidate this case with another action pending in this district: Lewis v. Hirschbach Motor Lines, Inc., et al., No. 20-cv-01355, Doc. 392) (the "Lewis Action"). Navistar contends that there is significant overlap between certain issues of law and fact in both cases. The Court agrees and finds that it would promote judicial efficiency to consolidate these matters given the commonalities between them. Thus, the Court CONSOLIDATES this action with the Lewis Action pursuant to Federal Rule of Civil Procedure 42(a) for all further proceedings. As the practice in this District is to consolidate into the lower numbered case, the Lewis Action 3:20-CV-01355-NJR shall constitute the lead case, and every filing in this case shall denote that lead case number and be filed on that docket.
