SCREENING ORDER: Represented by counsel and having paid the full filing fee, Sarah Bishop brings this civil rights action pursuant to 42 U.S.C. 1983 against City of Belleville, Illinois and Belleville Police Officers for violating her rights under the Fourth Amendment, Americans with Disabilities Act (ADA), Rehabilitation Act (RA), and Illinois state law on or around July 18, 2025. Because she is currently detained at St. Clair County Jail, Plaintiff's Complaint is subject to review under 28 U.S.C. 1915A, which requires screening and dismissal of portions that are frivolous or malicious, fail to state a claim, or seek money damages from an immune defendant. Id. Upon review, the Court finds that Plaintiff has articulated a colorable federal cause of action in COUNT 1, a Fourth Amendment excessive force claim against BECKER, BRINSON, and LEGGETT; COUNT 2, a failure-to-intervene claim against BECKER, BRINSON, LEGGETT, and WILSON; COUNT 3, a Fourth Amendment denial of medical care claim against BECKER, BRINSON, LEGGETT, and WILSON; COUNT 4, an ADA / RA claim against CITY OF BELLEVILLE; COUNT 5, an Illinois battery claim against BECKER, BRINSON, and LEGGETT; COUNT 6, an Illinois Civil Rights Remedies Restoration Act claim against CITY OF BELLEVILLE; and COUNT 7, an Illinois indemnification clam against CITY OF BELLEVILLE. Plaintiff shall initiate service on ALL DEFENDANTS without further delay. Defendants shall timely file an appropriate responsive pleading to the Complaint and shall not waive filing a reply pursuant to 42 U.S.C. 1997e(g).
