MEMORANDUM AND ORDER granting in part and denying in part 3 Motion to Dismiss and 5 Motion to Dismiss. The Court rules that plaintiffs are not the real parties in interest for these claims, and plaintiffs are granted leave until October 18, 2010, to substitute or join the bankruptcy trustee as plaintiff. Count IV is dismissed for failure to satisfy the notice requirement of the Clean Water Act. Any constitutional takings claims asserted in Count III are dismissed as unripe.
