Filing 41 MEMORANDUM AND ORDER granting in part and denying in part 31 Defendants' Motion for Entry of Protective Order; granting in part and denying in part 32 Plaintiff's Motion for Protective Order. Plaintiff's motion is granted as to h is proposed competitor witness notice provision using the narrower scope of entities involved in the design, manufacture, or distribution of "forced-air patient warming products," but with the addition of a reference to "Augustine Biom edical & Design's HotDog Patient Warming System." Defendants' motion is granted with respect to their proposed provision for challenges to confidential designations and their provision requiring that expert reports containing confident ial information be designated as confidential; provided, however, the language is revised so that it applies to any expert-created report or document "quoting, discussing, or incorporating" designated confidential information. Defendants ar e directed to make the necessary revisions to their proposed Protective Order in accordance with the Court's rulings and circulate the revised version to opposing counsel for review.
