IT IS THEREFORE ORDERED that defendant's motion to dismiss (Doc. 38) is denied as to Counts I, IV, and V. IT IS FURTHER ORDERED that de fendant's motion to dismiss is granted as to plaintiff's negligent hiring and retention claim, but the court retains jurisdiction over plaintiff's negligentsupervision claim against defendant in Count II. Defendant's motion to dismiss is also granted as to Counts III and VI. IT IS FURTHER ORDERED that defendant Robert McDonald is dismissed as a defendant in this case.
