MEMORANDUM AND ORDER granting in part and denying in part 102 Plaintiffs' Motion to Compel Disclosure of Defendant's Financial Information. The motion is denied as to Request Nos. 6, 7, and 8. The motion is granted in part as to Request Nos. 5 and 9, subject to the following limitations: Request No. 5 will be limited to Defendant's quarterly, annual and year-end financial statements, consisting of its balance sheets and statements of profits and loss. Both Request Nos. 5 and 9 will be limited to Defendant's most recent financial information, which the Court defines as the one-year period prior to the date Defendant produces such information. Defendant shall produce documents and information responsive to Request Nos . 5 and 9 and in accordance with this Memorandum and Order within fourteen (14) days after the Court rules on 100 Defendant's Motion for Summary Judgment, provided that Plaintiffs' claim for punitive damages remains in the case.
