Filing 9 AMENDED COMPLAINT against All Defendants, filed by National Union Fire Insurance Company of Pittsburgh, PA.(Shapiro, Tony) |
Filing 8 ORDER re #5 Notice and Order to Show Cause and denying #7 plaintiff's Motion for Leave to Amend Complaint. The court has reviewed plaintiff's response (ECF 6) to the March 19 order to show cause. Plaintiff states in its response that the LLC defendants' sole member is defendant Charles Robinson III, an individual domiciled in Kansas. The court finds that plaintiff has sufficiently alleged diversity jurisdiction, therefore the court will not recommend dismissal for lack of subject-matter jurisdiction. Plaintiff's motion for leave to amend its complaint (ECF 7) is denied. Plaintiff is entitled to amend its complaint as a matter of course pursuant to Fed. R. Civ. P. 15(a)(1), therefore leave of court is not required. Signed by Magistrate Judge Angel D. Mitchell on 4/5/21. (This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.) (ks) |
