After hearing from the parties and noting the pending #17 motion to compel arbitration and stay proceedings filed by the Uber Defendants, the Court will defer entering a Scheduling Order at this time so that the parties can schedule and participate in an early mediation. The parties may proceed with written discovery during this time, but no depositions will be allowed. The parties shall file a Mediation Notice once mediation is scheduled, indicating the date mediation is scheduled to occur and the mediator selected. If the case does not settle at mediation and is not stayed pursuant to a ruling on the pending motion to compel arbitration, the parties shall email chambers a new proposed scheduling order by 7/6/2023 and the Scheduling Conference will be reconvened on 7/11/2023 at 11:00 AM by telephone before Magistrate Judge Teresa J. R. 7.1(d)(3) establishes that a principal brief in support of a motion "must not exceed 15 pages...." Nonetheless, Defendants (without seeking leave) filed a memorandum in support of its motion to compel arbitration that is 17 pages. Doc. 12. As a result, Plaintiff now seeks leave to file a pleading that is longer than 15 pages but "not to exceed 21 pages." Doc. 15. The better course is to adhere to the rules as written. Defendants' memorandum in support is stricken for failure to comply with the page limitation. Defendants are granted until April 19, 2023, in which to file a brief that complies with the local rules.
