December 13, 2023 Opinion or Order Filing 44 ORDER denying #10 "Plaintiff-Intervenor United States' Motion to Intervene"; denying #14 "Plaintiff-Intervenor United States' Second Motion to Intervene"; denying #18 "Amended Cert of Service Plaintiff-Intervenor United States' Second Motion to Intervene"; and denying #26 "Motion to Compel Joinder with the US Department of Justice." Notwithstanding the titles of the referenced motions, the United States did not file them, rather Plaintiff did. The United States has filed responses #12 , #23 , #24 , #29 , respectively, in opposition to each of the referenced motions. Although rambling, Plaintiff's motions request intervention or joinder of the United States in this case based principally upon Fed. R. Civ. P. 24, but Plaintiff offers no authority by which he is authorized to speak or request intervention in this case on behalf of the United States. To the contrary, in response to the first referenced motion #12 the United States debunks any such notion, noting that only the United States Attorney for the District of Kansas or an Assistant District United States Attorney delegated that authority by the United States Attorney for the District of Kansas has that power. The United States has not intervened in this case and has chosen not to intervene in the case. The Court agrees with the United States that neither Rule 24, nor any other authority cited by Plaintiff allows him to compel the United States to intervene in this case. The referenced motions are therefore denied and, moreover, the Court cautions Plaintiff against filing any additional motion(s) seeking to require the intervention or joinder of the United States in this case or any other motion(s) implying that Plaintiff is requesting relief on behalf of the United States. December 6, 2023 Opinion or Order Filing 37 MEMORANDUM AND ORDER. Plaintiff's motion to combine the pleadings (Doc. #27 ) is denied. However, the court will allow Plaintiff to file a motion to amend his complaint and attach a proposed amendment that includes all of the factual allegations that are relevant to his claims. Plaintiff's motion to amend must be filed by 12/15/2023. At this time, Plaintiff is restricted from filing any documents or motions in this action unless his filing is a motion to amend the complaint, proper responses or reply briefs to motions currently pending, or a response to a dispositive motion if one is filed by Defendant. If Defendant files an answer and declines to file a dispositive pleading, Plaintiff is precluded from filing any documents until the court has had time to rule on the matters currently pending. After such time, a scheduling conference will be held. Should Plaintiff seek to file any other motions, pleadings, or any other document other than those authorized herein, Plaintiff must first seek leave from the court. In order to do that, Plaintiff must file a motion to asking the court to approve his proposed filing, along with the reason why the filing is necessary at the time, and attach the proposed filing to the motion. The court will rule on the motion expeditiously. To the extent the court determines that a hearing is appropriate before ruling on any such motion, such hearings will generally be held in person at the federal courthouse in Wichita, Kansas.
