December 29, 2023 Opinion or Order Filing 38 ORDER denying #15 Plaintiff's Motion to Intervene. Although rambling, Plaintiff's Motion requests relief on behalf of his minor children and intervention of the United States in this case. As the Court has previously ruled and instructed Plaintiff, he is not an attorney and therefore cannot seek relief on behalf of other persons, including his minor children. Nor does Plaintiff have authority pursuant to Fed. R. Civ. P. 24 or any other authority cited by Plaintiff to request intervention in this case on behalf of the United States. See Escalante v. Burmaster, Case No. 23-cv-2471 (ECF No. 44). The referenced motion is therefore denied and Plaintiff is cautioned once again against filing any other or additional motion(s) seeking relief on behalf of other persons or to require the intervention or joinder of the United States. December 27, 2023 Opinion or Order Filing 37 ORDER denying #5 Plaintiff's Motion to Consolidate Case Nos. 23-2491 and 23-2471. Plaintiff seeks consolidation pursuant to Fed. R. Civ. P. 42(a), which provides "When actions involving a common question of law or fact are pending before the court, it may order... all the actions consolidated." Although Mr. Escalante is the plaintiff in the two cases that he seeks to have consolidated, the cases are brought against different defendants - a Kansas State court judge, in Case No. 23-2471, versus Plaintiff's ex-wife, an attorney, and a guardian ad litem in Case No. 23-2491. The relief sought in the two cases is different and, notwithstanding Plaintiff's conclusion statement to the contrary, it is not at all clear from the pleadings that there are common questions of law or fact in the two cases. Additionally, different lawyers represent the defendants in the two cases. The determination of whether to grant a motion for consolidation is discretionary with the Court. In this case, the Court finds Plaintiff has failed to show what, if anything, would be gained by consolidation or that he will suffer any injury by failure to consolidate. See Shump v. Balka, 574 F.2d 1341, 1344 (10th Cir. 1978). In its discretion, the Court therefore denies Plaintiff's request for consolidation. Signed by Magistrate Judge Teresa J. James on 12/27/2023. Plaintiff's Complaint states that Plaintiff is bringing it on behalf of his daughters, Plaintiff S.J.E. And Plaintiff S.G.E., minor children. However, Plaintiff is not an attorney and he cannot bring the complaint on behalf of any other person, including his minor children. Jackson v. United States, No. 22-cv-02357-KHV, 2023 WL 2631528, at *2 (D. Kan. Mar. 24, 2023)("[Pro se] Plaintiff cannot bring claims asserting the rights and interests of her son or her grandchildren because she cannot assert the personal rights or interests of any other person"). In addition, Plaintiff's Complaint is deficient because not in compliance with D. Kan. Rule 83.6.3(b)(1)(B), which requires complaints against attorneys practicing before this court for any cause or conduct that may justify disciplinary action to be filed "under oath" unless filed by a judge or magistrate judge of this court.
