ORDER ADOPTING the Magistrate Judge's 10 Report and Recommendation. Plaintiff's Objections are overruled. Plaintiff's claims against Defendants Johns, Cross, and Willis are hereby dismissed for failure to state a claim upon which relief may be granted.
