April 30, 2024 Opinion or Order Filing 9 ORDER denying without prejudice #8 Plaintiff's Motion to Terminate Contract. Plaintiff's Motion requests a court order directing Defendant to immediately terminate its contract with Plaintiff. However, Defendant has not yet been served because the Court is still addressing the issue of whether Plaintiff is entitled to proceed with a lawsuit in federal court without prepayment of fees. The Court notes that Plaintiff recently filed #7 Objections to the pending #4 Report and Recommendation, which recommends that the District Judge deny the motion for leave to proceed without prepayment of fees. Given the procedural state of the case, the Court denies the Motion without prejudice to refiling at a later stage, if appropriate. Signed by Magistrate Judge Rachel E. Schwartz on 4/30/2024. A copy of this order was mailed to Plaintiff at the address listed on the docket. (This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.)
