Plaintiff is entitled to receive future benefits based on the stipulated maximum benefit of 70% of pay (with appropriate reductions for his elections). For past benefits he may be entitled to recover the difference between t his 70% benefit and the benefits he has actually received. The parties are directed to submit a joint statement within 30 days of this order setting forth the amount of benefits due under the courts findings. The court will enter final judgment after receipt of the joint statement. Employer and the Plan are entitled to recover from Plaintiff the sum of $40,067 for Plaintiff's breach of fiduciary duties and engagement in prohibited transactions.
