MEMORANDUM OPINION AND ORDER by Judge Joseph H. McKinley, Jr. on 8/24/2009. For the foregoing reasons, Defendant Strode's motion to dismiss, which the Court has construed as a motion for summary judgment (DN 21 ), is GRANTED. Plaintiff's response (DN 22 ), which the Court construes to be a motion to amend the complaint, is DENIED. MEMORANDUM OPINION by Judge Joseph H. McKinley, Jr. on 2/19/2009; For the foregoing reasons, by separate order, Plaintiff's official capacity claims against Defendants will be dismissed. Plaintiff's claims for injunctive relief in the form of dismissing the first-degree assault charges against him will be dismissed. The Court will allow Plaintiff's claims against Defendants in their individual capacities to go forward.
