Filing 27 MEMORANDUM OPINION AND ORDER by Chief Judge Joseph H. McKinley, Jr. on 11/6/2014. IT IS HEREBY ORDERED that the motion by Plaintiff, IP, LLC, for a temporary restraining order and preliminary injunction (DN 14 ) is GRANTED IN PART AND DENIED IN PA RT consistent with this Memorandum Opinion. The Court grants a preliminary injunction for specific performance of Paragraph 3(b) of the Settlement Agreement requiring Interstate Vape to "cause to be removed" all references to Interstate Vape products which bear the 24/7 designation from third-party websites. (See Order for specifics and further direction.) No later than 12/5/2014, Defendants shall certify to the Court the steps they took to comply with this Order. cc: Counsel (CDR) |
