October 6, 2017 Opinion or Order Filing 6 MEMORANDUM OPINION AND ORDER by Judge Greg N. Stivers on 10/5/2017. The following claims shall continue on initial review of the complaint and amended complaint: (1) the Fourteenth Amendment claim of delayed treatment against Defendant Washington in his individual capacity for damages; and (2) the Fourteenth Amendment and medical malpractice claims against Twin Lakes and Dr. Thomas in his individual capacity. Within 30 days from the entry date of this Order, Plaintiff must file fully compl eted summons forms for Defendants Washington, Twin Lakes, and Dr. Thomas. Upon receipt of the completed summonses filed by Plaintiff, the Clerk of Court shall issue the summonses. Plaintiff may file a motion requesting the Court to order that service be made by the USMS. All other claims are DISMISSED for failure to state a claim upon which relief may be granted. As all claims against Defendants Woosley, GCDC "Medical department," Rita, Gary, and Mike are dismissed, the Clerk of Court is DIRECTED to terminate them from this action. cc: Plaintiff, pro se (with three blank summons forms and motion form); Defendants; Grayson County Attorney (CDR)
