IT IS FURTHER ORDERED that Counts I and II of the plaintiffs complaint are DISMISSED t o the extent that they allege that the defendant breached obligations not to compete and solicit in relation to the plaintiff under paragraphs (c) and (d) in section 6 of the physician services agreement. The defendants remaining allegations in Counts I and II may proceed. IT IS FURTHER ORDERED that Count III of the plaintiffs complaint is DISMISSED.IT IS FURTHER ORDERED that the defendant shall timely file an answer to the remaining allegations of the complaint. cc:counsel (JBM)
