MEMORANDUM OPINION AND ORDER by Judge John G. Heyburn, II on 5/9/2011; for the foregoing reasons, re 1 Complaint filed by Michael Thomas, the Court DISMISSES the official-capacity claims. However, the Court will allow Plaintiff to amend his complai nt to name Defendants in their individual capacities. Plaintiff has 30 days to file an amended complaint against Defendants in their individual capacities.
