June 11, 2012 Opinion or Order Filing 29 MEMORANDUM OPINION AND ORDER by Judge John G. Heyburn, II on 06/08/12 granting in part and denying in part Plaintiff's 22 Motion for Leave to Amend the original Complaint. Clerk of Court is DIRECTED to sendPlaintiff a § 1983 form packet s hould Plaintiff wish to initiate a separate action. The Clerk of Court shall forward by certified mail, return receipt requested, one copy of the amended complaint (DN 22) and this Memorandum Opinion and Order, to the Justice & Public Safety Cabinet, Office of Legal Counsel, Frankfort, Kentucky. General Counsel shall have 30 days after receipt by certified mail to complete and return a notice of waiver of service forDeckard. Should counsel for the Justice & Public Safety Cabinet not represent De ckard, the Court requests General Counsel to provide a forwarding or last known address for her so that it may ensure service. Plaintiff is WARNED that in the event he receives such notification, he must take steps to remedy the defect in service. Fa ilure to do so within 120 days of entry of this Order may result in dismissal of Deckard. Deckards answer to the amended complaint shall be filed no later than 60 days after waiver of service. However, if service is required, the answer shall be file d no later than 21 days after service of summons. Jeffersons answer to the amended complaint shall be filed no later than 21 days from the entry date of this Memorandum Opinion and Order.
