Heyburn, II on 1/22/13: Beacons 20 motion for partial summary judgment on its contract claim is SUSTAINED; Beacon is entitled to and shall recover its reasonable attorneys fees and expenses in connectio n with this partial summary judgment action. MDTs 21 motion to dismiss Beacons claim for conversion and punitive damages is SUSTAINED and those claims are DISMISSED WITH PREJUDICE. MDTs 22 motion to stay Plaintiffs motion for partial summary jud gment is DENIED. Beacons 28 motions for extension of time to file a response to MDTs motion to dismiss Beacons conversion claim and to file a reply to its motion for partialsummary judgment on its contract claim are rendered MOOT by this decision. The remaining claims in this case are Beacons request for declaratory judgment as to future VAT refunds that may be received by MDT, its breach of contract claim regarding MDTs nonpayment of rent and its request for injunctive relief concerning misuse of Beacons name and various account numbers as delineated in Beacons Complaint. cc:counsel (DAK)
