MEMORANDUM OPINION AND ORDER Signed by Judge David J. Hale on 9/28/2017: Cabela's motion 19 to stay proceedings is DENIED. Cabela's motion 20 to dismiss and to strike class allegations is GRANTED IN PART AND DENIED IN PART. The m otion to dismiss is DENIED. The motion to strike is DENIED WITHOUT PREJUDICE as to Eldridge's Autodialed No Consent Class. The motion to strike is GRANTED as to Eldridge's Autodialed Stop Class and Pre-recorded Stop Class. Eldridge shall have fourteen (14) days from the date of entry of this Order within which to file an amended complaint correcting the definition of the Autodialed No Consent Class. cc: Counsel (JBM)
