P. 23(b)(3) by Plaintiff Class Representatives on behalf of the subclasses. Attorneys James D. Ballinger and Gregory A. Belzley are appointed as co-class counsel for Plaintiffs as they meet all of the requirements of Fed. R. Civ. P. 23(g). Plaintiffs Larry Louis Hibbs, Jr. and Allen Goodfleisch are not part of the proposed class. Defendants motion for an extension of time to file their answer to Plaintiffs complaint (D.N. 6 ) is DENIED as unnecessary. Plaintiffs motion for a hearing (D.N. 7 ) is DENIED without prejudice. Plaintiffs motion for leave to file a second amended complaint (D.N. [ 8]) and motion for a status conference (D.N. 15 ) are GRANTED. Plaintiffs shall have fourteen (14) days from the date of entry of this Order within which to file an amended complaint. Defendants shall have fourteen (14) days thereafter in which to f ile their answer to Plaintiffs second amended complaint. This matter is REFERRED to U.S. Magistrate Judge Dave Whalin for resolution of all litigation planning issues, entry of scheduling orders, consideration of amendments thereto, and resolution of all non- dispositive matters, including discovery issues.
