Plaintiff's claims against Defendant are DISMISSED without prejudice. Defendant's requests for attorney fees an d costs and to compel arbitration are DENIED. Within fourteen (14) days of entry of this Order, the parties shall file a joint report advising the Court of the status of the arbitration proceeding. Thereafter, the parties shall promptly inform the Court of the resolution of this matter and file an Agreed Order of Dismissal with Prejudice within twenty-one (21) days of resolution.
