Plaintiff's claims against Defendants Erwin, Holcomb, Kaelin, Baptist, Jain, and Oldham County EMS personnel; his claim regarding the denial of use of an ele ctric wheelchair; claims under the ADA and RA; and claim alleging denial of access to the court are DISMISSED pursuant to 28 U.S.C. § 1915A(b)(1) for failure to state a claim upon which relief may be granted. The Clerk of Court is DIRECTED to change the name of Defendant Correct Care Solution to Correct Care Solutions in the docket sheet. Because no claims remain against Defendants Erwin, Holcomb, Kaelin, Baptist, Jain, Amos, and Oldham County EMS personnel, the Clerk of Court is DIRE CTED to terminate them as parties to this action. The Court having dismissed Defendant Baptist as a party to this action, Baptist's motion to dismiss the second amended complaint under Fed. R. Civ. P. 12(b)(6) (DN 29 ) is DENIED as moot. Th e Court will enter a separate Service and Scheduling Order to govern the claims that have been permitted to proceed. In allowing the claims to go forward, the Court passes no judgment on their merit or ultimate outcome. Parties shall comply as set forth in Order. cc: Counsel, Pro Se Plaintiff, Defendants (MEJ) |
